Client Cases

In 2016, David Jones helped a small local business win a favorable settlement. In this matter, David Jones served as lead counsel, ready to go to trial if he was not able to settle on terms that met his client’s needs. The client’s insurance company initially refused to consider the settlement, even though a lawsuit had been filed by the corporation’s former employee. While the insurance company would only initially offer to settle for the employee’s medical expenses, Mr. Jones obtained a release, with the corporation fully released and indemnified. The domestic contribution doctrine applied so that Mr. Jones was able to negotiate an apportionment in accordance with that doctrine allowing the corporation to settle with its former employee while obtaining an indemnity from its general manager who resigned in lieu of being fired for reasons which also gave rise to the suit. A similar matter was solved for another client in 2015. The firm represented the corporate client in a breach of contract action where its attorney committed malpractice by failing to properly assert a claim for punitive damages in the answer. After confirmation of the damages amount, Mr. Jones was able to recover from the attorney’s malpractice coverage the amount of damages the corporate client would have been able to recover but for the malpractice problem. That settlement also included the settlement of the corporate client’s claim against its former employee for breach of fiduciary duties and violation of trade secret laws, including confidentiality obligations and a non-solicitation clause. Mr. Jones completely defeated a catastrophic wrongful death/truck accident case where his client was sued as a "new" corporation including having its officers as defendants in the lawsuit. The plaintiff settled with other defendants and paid an undisclosed sum in damages while Mr. Jones obtained summary judgment based upon evidence that the corporate client was a completely new and separate entity. The federal district court judge awarded a very large sum in attorney’s fees for the corporation’s successful defense. That case was famously known as the case where the truck driver collided with a chicken truck which was trying to avoid an alligator in the road, leading truck and auto and tractor trailer and chicken truck collisions causing deaths and devastation.
Community Service
David Jones is committed to making a positive difference in the lives of those less fortunate. Mr. Jones is an active member of the Pro Bono Committee at the Justice Center of Atlanta and has been volunteering with them for several years. He is also a member of the Georgia Association for Women Lawyers and plays mentorship roles with several young lawyers throughout the state.
